1. Agreement to Terms
By accessing or using Protaja (“Service”), operated by Atlas Digital Group, LLC (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.
2. Description of Service
Protaja is an AI-powered client retention platform that helps small business owners re-engage lapsed clients via SMS. The Service includes a mobile application, web dashboard, and automated messaging infrastructure.
3. Eligibility
You must be at least 18 years old and operate a legitimate business to use the Service. You must have obtained proper consent from clients before uploading their contact information to Protaja.
4. Account Registration
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. Notify us immediately at support@protaja.com if you suspect unauthorized access.
5. SMS Messaging & Compliance
You agree to use the SMS messaging features of Protaja in compliance with all applicable laws, including the Telephone Consumer Protection Act (TCPA) and regulations issued by the Federal Communications Commission (FCC).
You represent and warrant that:
- You have obtained appropriate consent from each client before sending them messages through Protaja
- You will honor all opt-out requests promptly. Protaja automatically processes STOP replies on your behalf.
- You will not use Protaja to send unsolicited messages, spam, or messages for unlawful purposes
- Messages sent comply with carrier guidelines and 10DLC requirements
By importing or adding contacts to Protaja, you confirm that each contact has provided their phone number to your business directly and has an existing relationship with your business. You further confirm that these contacts have consented to receive SMS communications from your business.
Messages sent through Protaja include: client re-engagement outreach, appointment reminders, and service follow-ups. All messages are reviewed and approved by the business owner before sending.
All messages sent through Protaja include opt-out instructions. Recipients may reply STOP to unsubscribe at any time. Reply HELP for support.
You are solely responsible for the content of messages sent through your account and for compliance with applicable messaging laws in your jurisdiction.
6. Client Data
You retain ownership of all client data you upload to Protaja. By uploading client data, you grant us a limited license to process it solely for the purpose of providing the Service. We will not sell, share, or use your client data for any purpose other than providing the Service to you.
7. Subscription & Billing
Protaja is offered on a monthly subscription basis. You authorize us to charge your payment method on file on a recurring monthly basis. Plans may have message caps; overage is charged at the rate disclosed at time of purchase.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.
8. Acceptable Use
You agree not to:
- Use Protaja for any unlawful purpose
- Attempt to reverse engineer or access the underlying AI systems
- Upload client data you do not have the right to use
- Use the Service to harass, threaten, or harm any person
- Resell or sublicense access to the Service
- Use automated tools to scrape or extract data from the Service
9. Intellectual Property
The Service and its underlying technology, including the AI models, user interface, and brand assets, are owned by Atlas Digital Group, LLC. You are granted a limited, non-exclusive license to use the Service during your active subscription. All rights not expressly granted are reserved.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED MESSAGES WILL ACHIEVE ANY PARTICULAR BUSINESS RESULT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATLAS DIGITAL GROUP, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless Atlas Digital Group, LLC from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights including SMS messaging laws.
13. Termination
Either party may terminate the relationship at any time. We reserve the right to suspend or terminate accounts that violate these Terms, particularly regarding SMS compliance. Upon termination, your access to the Service ends and we will delete your data within 30 days per our Privacy Policy.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law provisions. Any disputes shall be resolved in the state or federal courts of Delaware.
15. Changes to Terms
We may update these Terms from time to time. We will notify you via email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
